1) Scope of Application
The purchase of a GPS tracker and the optional FINDER-Portal subscription form two legally separate contractual relationships with different terms and cancellation rules.
1.1 These General Terms and Conditions (hereinafter “T&Cs”) of Salind UG (limited liability) (hereinafter “Seller”) apply to all contracts that a consumer or business (hereinafter “Customer”) concludes with the Seller regarding the GPS trackers and accessories presented in the Seller's online shop.
1.2 A consumer within the meaning of these T&Cs is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession. A business within the meaning of these T&Cs is a natural or legal person or a legally capable partnership that acts in the exercise of their commercial or independent professional activity when concluding a legal transaction.
2) Conclusion of Contract
2.1 The product descriptions contained in the Seller's online shop do not constitute binding offers on the part of the Seller, but serve to enable the Customer to submit a binding offer.
2.2 The Customer can submit the offer via the online order form integrated into the Seller's online shop. After placing the selected goods in the virtual shopping cart and completing the electronic ordering process, the Customer submits a legally binding contractual offer with regard to the goods contained in the shopping cart by clicking the button that completes the ordering process.
2.3 The Seller may accept the Customer's offer within five days,
- by sending the Customer a written order confirmation or an order confirmation in text form (fax or email), the receipt of which by the Customer is decisive, or
- by delivering the ordered goods to the Customer, the receipt of which by the Customer is decisive, or
- by requesting the Customer to pay after the Customer has placed their order.
2.4 If several of the alternatives above apply, the contract is concluded at the point in time when one of the alternatives first occurs. If the Seller does not accept the Customer's offer within the period, this is deemed to be a rejection of the offer.
3) Right of Withdrawal
3.1 Consumers are generally entitled to a right of withdrawal.
3.2 As a customer-friendly contractual additional service, the Seller grants consumers a withdrawal period of 30 days — an extension beyond the statutory 14-day period under § 355 of the German Civil Code (BGB). The 30-day period applies uniformly to the supply of goods, regular deliveries (e.g. subscriptions) and digital content.
3.3 Further information on the right of withdrawal can be found in the Seller's cancellation policy.
4) Prices and Terms of Payment
4.1 Unless otherwise stated in the Seller's product description, the prices indicated are total prices that include statutory VAT. Any additional delivery and shipping costs will be indicated separately in the respective product description.
4.2 The Customer has various payment options available, which are indicated in the Seller's online shop. The Seller currently accepts the following payment methods:
- PayPal
- Stripe (credit card, SEPA direct debit, Apple Pay, Google Pay)
- Amazon Pay
- Invoice purchase
- Advance payment / bank transfer
4.3 If the payment method advance payment is selected, the Seller will inform the Customer of the bank details in the order confirmation. The invoice amount is to be transferred to the Seller's account within 7 days of receipt of the order confirmation.
5) Delivery and Shipping Conditions
5.1 Goods are delivered by shipping route to the delivery address specified by the Customer, unless otherwise agreed.
5.2 The Seller offers free shipping for all EU countries. Outside the EU, shipping costs are indicated separately.
5.3 If delivery of the goods fails for reasons for which the Customer is responsible, the Customer shall bear the reasonable costs incurred by the Seller as a result.
5.4 If the Seller ships the goods to the Customer, the Customer as a business bears the risk of accidental loss and accidental deterioration from the handover of the goods to a suitable transporter. For consumers, the risk only passes upon handover of the goods to the consumer or an authorized recipient.
6) Lawful Use and International Use
IMPORTANT NOTICE: THE USE OF OUR DEVICES TO TRACK PERSONS WITHOUT THEIR EXPRESS CONSENT IS STRICTLY PROHIBITED. A VIOLATION OF THIS PROVISION MAY IN PARTICULAR FULFIL THE CRIMINAL OFFENCES OF § 238 OF THE GERMAN CRIMINAL CODE (STGB — STALKING) OR OTHER LEGAL NORMS.
6.1 When using the GPS trackers offered by the Seller, the Buyer is obliged to observe the relevant legal regulations. This includes in particular data protection and personal rights requirements. The tracking of persons without their express consent may constitute a criminal offence within the meaning of § 238 StGB, for the legal consequences of which the Buyer is exclusively responsible.
6.2 The technical availability of the devices in the respective foreign country does not automatically mean that their use is also legally permitted. The Buyer must independently verify whether the use of the tracker in the respective destination country is compatible with the data protection, telecommunications and radio frequency regulations applicable there. The Seller assumes no liability for any inadmissible use abroad.
6.3 In the event of violations of the above provisions, the Seller reserves the right to terminate the subscription immediately and to withdraw from the contract.
7) Retention of Title
If the Seller makes advance payment, the Seller retains ownership of the delivered goods until the purchase price owed has been paid in full.
8) Liability for Defects (Warranty)
8.1 If the purchased item is defective, the provisions of statutory liability for defects apply.
8.2 Towards consumers, the limitation period for warranty claims for new goods is two years from delivery of the goods. The shorter statutory limitation period of one year for used items remains unaffected.
8.3 Towards businesses, the limitation period for warranty claims for newly manufactured items is one year from delivery of the goods. Towards businesses, the warranty is excluded when selling used items.
8.4 Claims for damages are not restricted by this. These are governed solely by Section 9 of these T&Cs and by statutory provisions.
9) Redemption of Promotional Vouchers
9.1 Vouchers issued by the Seller free of charge as part of promotions with a specific validity period (hereinafter “promotional vouchers”) can only be redeemed in the Seller's online shop and only within the specified period.
9.2 Individual products may be excluded from the voucher promotion if a corresponding restriction results from the content of the promotional voucher.
9.3 Promotional vouchers can only be redeemed before completion of the ordering process. Subsequent offsetting is not possible.
9.4 Only one promotional voucher can be redeemed per order.
10) Applicable Law
The law of the Federal Republic of Germany applies to all legal relationships between the parties, excluding the laws on the international purchase of movable goods. For consumers, this choice of law only applies insofar as the protection granted is not withdrawn by mandatory provisions of the law of the country in which the consumer has their habitual residence.
11) Place of Jurisdiction
If the Customer acts as a merchant, legal entity under public law or special fund under public law with its registered office in the territory of the Federal Republic of Germany, the exclusive place of jurisdiction for all disputes arising from this contract is the Seller's place of business (Siegburg). If the Customer has its registered office outside the territory of the Federal Republic of Germany, the Seller's place of business is the exclusive place of jurisdiction for all disputes arising from this contract if the contract or claims from the contract can be attributed to the Customer's professional or commercial activity.
12) Code of Conduct
The Seller has not subjected itself to any specific codes of conduct.
13) Alternative Dispute Resolution
13.1 The EU Commission provides a platform for online dispute resolution at: https://ec.europa.eu/consumers/odr.
This platform serves as a contact point for the out-of-court settlement of disputes arising from online purchase or service contracts involving a consumer.
13.2 The Seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
